Nicola Bolton Pilates - Terms & Conditions

1. Agreement

1.1. These Terms and Conditions form the agreement between Nicola Bolton Pilates (“the Studio”) and you (“the Client”) in relation to all classes, memberships, and class packs.
1.2. By purchasing a class, pack, or membership, or by attending a session, you agree to be bound by these Terms and Conditions.

2. Attendance

2.1. Please bring your own water bottle and mat/towel if preferred.
2.2. Appropriate and comfortable workout attire must be worn.
2.3. Please arrive at least 5 minutes early for your first session.
2.4. Late arrivals will not be admitted once class has commenced. The studio door will be locked and the booking will be treated as a late cancellation.
2.5. Respectful conduct is required at all times. The Studio reserves the right to refuse service where behaviour is unsafe or inappropriate.

3. Personal Belongings

3.1. Nicola Bolton Pilates is not responsible for loss or damage to personal belongings brought into the studio.

4. Classes

4.1. All classes must be booked in advance via the Studio’s booking platform (Momence).
4.2. Group Pilates classes are 45 minutes in duration unless otherwise stated.

5. Payments

5.1. All classes, packs, and memberships must be prepaid.
5.2. Payments are processed securely through the Studio’s online booking system Stripe.

6. Memberships

6.1. Memberships operate on a recurring billing basis and provide access to classes as outlined at the time of purchase.
6.2. All memberships have a minimum commitment period of four (4) weeks from the commencement date.
6.3. Memberships will automatically continue after the minimum term unless cancelled in accordance with Clause 7.
6.4. Unused classes included in a membership do not roll over unless explicitly stated.

7. Membership Cancellations

7.1. Requests to cancel a membership must be submitted in writing via email or through the Momence app chat.
7.2. Cancellations cannot be processed via social media, verbal communication, or in-class requests.
7.3. A minimum notice period of 7 days is required to cancel a membership.
7.4. Memberships cannot be cancelled during the initial 4-week minimum commitment period.
7.5. Membership fees charged during the notice period are payable and non-refundable. Class credits can be used in this time.

8. Membership Holds (Freezes)

8.1. Memberships may be placed on hold for up to four (4) weeks per calendar year.
8.2. Hold requests must be made in advance via email or Momence chat and are subject to approval.
8.3. Holds cannot be applied retrospectively.
8.4. Memberships will automatically resume at the end of the approved hold period.

9. Fee Reviews and Changes

9.1. Nicola Bolton Pilates reserves the right to review and adjust membership fees where necessary.
9.2. Clients will be provided with reasonable written notice of any changes to fees before they take effect.
9.3. If a fee increase occurs, clients may cancel their membership in accordance with the cancellation terms outlined above.

10. Cancellations & Refunds (Classes and Packs)

10.1. All class and pack purchases are non-refundable, except where required under Australian Consumer Law.
10.2. A 4-hour cancellation policy applies to all classes.
10.3. Cancellations made less than 4 hours before class commencement will forfeit the class credit.
10.4. Cancellations made more than 4 hours prior will have the class credit returned.
10.5. All cancellations must be processed via the Momence app or website.

11. Medical Screening & Health

11.1. You are responsible for ensuring you are medically fit to participate in classes.
11.2. You must disclose any injuries, medical conditions, or health concerns that may affect your ability to safely participate.

12. Liability & Risk

12.1. Participation in Pilates involves inherent risks. You acknowledge and accept these risks.
12.2. To the extent permitted by law, Nicola Bolton Pilates is not liable for injuries sustained during sessions.
12.3. Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under Australian Consumer Law.

13. Privacy

13.1. Personal information is collected and used solely for studio operations, bookings, and communication.
13.2. Information will not be disclosed to third parties except as required by law.

14. Promotional Photography

14.1. Photos or videos may be taken during classes for promotional purposes.
14.2. Please notify the Studio if you do not wish to be included..

At Nicola Bolton Pilates, we are committed to protecting your privacy. This policy outlines how we collect, use, disclose, and manage your personal and health information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Information We Collect

To provide you with high-quality Pilates instruction and manage your membership, we collect:

  • Personal Information: Name, address, email, phone number, and date of birth.

  • Health Information: Injury history, pregnancy status, and general physical health details to ensure your safety on the mat.

  • Payment Information: Credit card or bank details (processed securely via our third-party provider, Momence/Stripe).

  • Attendance Data: Classes attended, cancellations, and purchase history.

2. How We Collect Information

We collect information directly from you when you:

  • Register an account via Momence.

  • Communicate with us via email, social media, or phone.

  • Visit our website (cookies may be used to improve user experience).

3. Purpose of Collection

We use your information to:

  • Provide Pilates classes and personalised instruction.

  • Ensure your physical safety and tailor exercises to your health needs.

  • Process payments and manage bookings.

  • Send studio updates, class reminders, and marketing (you may opt-out of marketing at any time).

  • Comply with legal and insurance obligations.

4. Storage and Security

Your data is primarily stored through Momence, our studio management software. Momence uses industry-standard encryption to protect your data.

  • We do not store full credit card details on our local devices.

  • Access to your health information is restricted to authorised staff (instructors) who need it to conduct safe classes.

  • We take reasonable steps to protect your information from unauthorised access, loss, or disclosure.

5. Disclosure to Third Parties

We do not sell your personal information. We only disclose your information to:

  • Third-party service providers who assist in our operations which includes Momence & Stripe for payment processing.

  • Health professionals, only if required in an emergency or with your explicit consent.

  • Regulatory authorities, if required by Australian law.

6. Access and Correction

You have the right to access the personal information we hold about you and request corrections if the data is inaccurate. You can update most of your details directly through your Momence login or by emailing us at hello@nicolaboltonpilates.com.au.

7. Minors

In line with our Studio Age Policy, we collect information regarding minors (aged 12–17) only with the express consent of a parent or legal guardian.

8. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal obligations. The updated version will be available on our website.
